The Family Educational Rights and Privacy Act of 1974 (“FERPA”) establishes the privacy rights of students with respect to their “education records,” a term broadly defined by FERPA. FERPA allows students to inspect, review, and request correction of their education records and, in most cases, requires prior written consent before such records are disclosed to third parties.
Certain federal student aid data maintained by institutions of higher education is also confidential information governed by the Higher Education Act of 1965 (“HEA”). That data may be used only as permitted by law and solely for the application, award, and administration of federal student aid, state aid, or other designated aid protected by the HEA. Student health records are likewise subject to FERPA, and the University may use or disclose such records only as permitted by FERPA or as required by law. Other than as permitted by FERPA, the HEA, or other applicable law, the University of Nebraska must obtain your informed consent prior to disclosing your confidential student information or education records.
Peter Kiewit Foundation Engineering Academy (“PKFEA”) at the University of Nebraska may access, use, and share student records in support of student academic progress and program development. By participating in PKFEA, you acknowledge and agree to the terms below:
1. Purpose of Disclosure of Records
The PKFEA collects and shares student records to:
- Monitor and evaluate program effectiveness
- Fulfill reporting requirements to the Peter Kiewit Foundation (“PKF”), including reporting for purposes of ensuring maintained eligibility for financial aid
- Facilitate research on the impact of PKF’s educational initiatives
2. Records Accessed and Shared
By signing this form, you authorize PKFEA to access and share the following types of records:
a. PKFEA Application
- Information contained in your PKFEA application and information regarding the evaluation and scoring of your application
b. Free Application for Federal Student Aid (“FAFSA”) Information
- Information submitted through the FAFSA
c. Academic Information
- Grades and GPA
- Demographic information
- Academic progress and enrollment status
- Participation in PKFEA and related programs
- Extracurricular and internship involvement
d. Financial Aid Information
- College-maintained loan and grant disbursements
- Award details and eligibility status
e. Student Account Information
- Tuition and fee charges
3. Disclosure to External Entities
PKFEA will share the records described above with the following entities:
- PKF
- Education Development Center (“EDC”)
- Nebraska Statewide Workforce and Education Reporting System (“NSWERS”)
The purpose of data sharing is to support research and evaluation of the PKF’s educational support programs and for purposes of determining eligibility for, the amount of, and conditions for aid, or to enforce terms and conditions of aid. All research partners are required to protect student confidentiality and use student records only for the intended research purposes.
4. Privacy and Compliance
All shared records are subject to the protections provided by FERPA and the HEA. PKF and its research partners designated in this consent form agree to handle all student information in compliance with these laws and any other applicable federal or state regulations.
5. Duration of Agreement
By enrolling in PKFEA and signing this agreement, you consent to the data practices described above. This agreement will remain in effect until you provide written notification to PKFEA requesting cancellation. Upon receiving such notice, the PKFEA will take appropriate steps to cease further sharing of your data. Refusal to share your data will result in scholarship loss.
Student Acknowledgment and Consent
Having read and understood the foregoing, I give permission to PKFEA of Nebraska to disclose the above information for the limited purposes and to the entities specified. I understand that this information may otherwise be considered confidential under FERPA, the HEA, or other applicable law. I understand that this waiver will remain in effect unless rescinded by me in writing and delivered to the Director of PKFEA. Any such rescission will be effective only upon receipt and will not retroactively invalidate disclosures properly made prior to that date.
